Terms & Conditions The fine print. June 12 2009

I'm just a soul whose intentions are good, oh Lord, please don't let me be misunderstood!

Due to the nature of what we are trying to do, namely make unauthorized customizations to the iPhone, iPod touch or iPad, there cannot be any guarantees whatsoever that any of this will work for you, or will remain working, or will be fixed when it breaks! Please follow all instructions carefully and read any provided documentation!

I am trying my best to keep up with the latest developments, but it may simply not be possible to do so. By using iFuntastic and its tools, you agree that you do so at your own risk!

I shall deal with you honorably, and I will not offer any feature that has not worked at least on my equipment.

Feature price, activation, activation codes, trial price, trial availability and trial duration are subject to change with or without notice. (It is a matter of survival.)

Rights & Responsibilities

By sending your payment or requesting features to be activated, you agree to the following terms and conditions:
  • with the activation of the feature(s), bitSplit™ Enterprises shall have fulfilled all of its obligations to you. I will try to give support, but at my discretion. Please do not be offended if I do not respond to your e-mail - I am just one person, and there are only 24 hours in a day; I shall however read your e-mail.
  • if you purchased a feature, then you are entitled to unlimited use of the feature with this version of iFuntastic
  • features activated for promotional or demo purposes may have expiration dates and/or subject you to promotional messages
  • a feature is to be used only with the single device that was connected at the time of purchase
  • you assume all risks and responsibilities associated with using a feature
  • features are sold "as is" and with the understanding that any modifications (including upgrades) to your computer and/or its software, or the device and/or its software, by you or Apple, Inc. or others, may break the features, and that bitSplit™ Enterprises may not (or may not be able to) fix the features in this or future versions of iFuntastic
Feature Activation - Purchase

To activate features you send a payment to bitSplit Enterprises via PayPal. A PayPal account is not required. An item number containing a user ID will be sent with the payment. The user ID is derived from the phone's serial number (the serial number cannot be recovered from the user ID.) Your purchases are tied to that ID - this means you can use the features only with the device you had connected at the time of purchase, but on any computer.

Once your payment has been made, your features will be enabled on the bSE server. No need for additional unlock codes or e-mails, but you will need to have internet access, at least initially, for iFuntastic to activate the features. iFuntastic checks the feature status periodically, and whenever you enter the Feature page, click 'Check Feature Status', click the top-left bSE Status button underneath the device status, or when iFuntastic starts up. iFuntastic will play a sound to notify you of a change in the feature status.

Feature Activation - Promotional Activation Codes

From time to time promotional activation codes may be made available. These codes can be entered into the iFuntastic application to activate features. They may require purchase of a lower level of features, but the codes themselves will always be available for free - don't ever pay for them! Features activated with a code may or may not carry over to future versions of iFuntastic (assume that they will not.) There will be no refunds for features that have been activated with a code.

Refund Policy

You can request a full refund within three days after the date of your purchase; thereafter, the refund will be decreased by $1 for each full day that has passed. If you would like a refund, please send an e-mail - a reason for your dissatisfaction would be appreciated. Feature(s) will be disabled after a refund. It is your responsibility to make sure your device is not in an 'in-between' or otherwise undesirable state when you request a refund or when the time limit (if any,) expires!

Terms and Conditions may change without notice; however, (with a nod to Dallas Judge Barbara Lynn, :-) you are only bound by the Terms and Conditions in effect at the time of your purchase.
